1. Service Description

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Bramblerest or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms are reserved by Bramblerest.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services. By submitting any content, you grant Bramblerest a worldwide, non-exclusive, royalty-free, perpetual, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the content you submit and that the content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights.

Bramblerest reserves the right to remove or refuse to post any content for any or no reason in its sole discretion.

7. Payment Terms

Access to certain features of the services may require payment of fees. You agree to pay all fees and charges associated with your account in accordance with the billing terms in effect at the time the fee or charge becomes due and payable. All fees are non-refundable unless otherwise stated in writing.

We reserve the right to change our pricing at any time. Any changes will be effective immediately upon posting on the services. Your continued use of the services after any changes to the pricing constitutes your acceptance of the new pricing.

In the event of a payment dispute, you must notify us within thirty (30) days of the charge. Failure to do so will constitute your acceptance of the charge.

8. Service Modifications

Bramblerest reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Bramblerest will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for updates. Your continued use of the services after any modifications constitutes your acceptance of the revised terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Bramblerest, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the services;
  • Any conduct or content of any third party on the services;
  • Any content obtained from the services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Bramblerest’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services.

10. Termination

We may terminate or suspend your account and access to the services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
